End User License Agreement

This End User License Agreement ("Agreement") is a legal agreement between you ("User") and xBrat Mobile Technologies FZCO ("Provider") governing your use of the xBratAI application ("App"). By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement. If you do not agree, do not use the App.

1. License Grant

xBrat Mobile Technologies FZCO grants you a limited, non-exclusive, non-transferable, revocable license to use xBratAI for personal, non-commercial purposes, subject to the terms of this Agreement. You may not sublicense, distribute, or otherwise make the App available to third parties.

2. User Obligations

Compliance: You agree to comply with all applicable laws, regulations, and this Agreement while using xBratAI.

Account Security: You are responsible for maintaining the confidentiality of your xBratAI account credentials and must not share them with others or allow unauthorized access to your account.

Prohibited Activities: You must not reverse-engineer, decompile, or modify xBratAI, or use it for any unlawful or unauthorized purpose.

3. Intellectual Property

Ownership: xBratAI, including all content, features, and underlying technology, is the exclusive property of xBrat Mobile Technologies FZCO and is protected by copyright, trademark, and other intellectual property laws.

No Ownership Transfer: Your use of xBratAI does not grant you ownership of any intellectual property rights in the App or its content. All rights not expressly granted in this Agreement are reserved by xBrat Mobile Technologies FZCO.

4. Restrictions on Use, Redistribution, and Commercial Exploitation

The protections in this Section apply to all proprietary materials made available through xBratAI, including but not limited to the App, its source code and object code, user interface, branding, trademarks, trading signals, alerts, notifications, watchlists, rankings, analytics, model outputs, generated content, methodologies, strategy logic, documentation, text, graphics, and databases (collectively, the "Protected Materials").

Prohibited Acts: You may not, in whole or in part, directly or indirectly, and whether or not for compensation:

1. copy, reproduce, duplicate, or store the Protected Materials beyond the scope of your personal, authorized use;
2. publish, post, broadcast, display, or otherwise make the Protected Materials publicly available;
3. transmit, forward, relay, syndicate, or distribute the Protected Materials to any third party;
4. resell, rent, lease, lend, sublicense, assign, or otherwise transfer access to the Protected Materials;
5. share, mirror, or republish the Protected Materials through any channel, group, or community, including but not limited to Telegram, Discord, WhatsApp, Signal, Slack, email lists, newsletters, social media, copy-trading or signal-sharing groups, paid or free membership communities, forums, or messaging bots;
6. use the Protected Materials to operate, supply, or support any competing, derivative, or value-added service;
7. scrape, harvest, crawl, index, or extract the Protected Materials using any automated means, including bots, scripts, spiders, or data-mining tools;
8. use the Protected Materials to train, fine-tune, or develop any artificial intelligence model, dataset, or algorithm; or
9. otherwise commercially exploit the Protected Materials in any manner not expressly authorized in writing by xBrat Mobile Technologies FZCO.

Confidentiality of Proprietary Elements: Certain non-public elements of the Protected Materials, including trading signals, alerts, methodologies, and strategy logic, are confidential and proprietary to xBrat Mobile Technologies FZCO. You agree not to disclose, publish, or share these elements with any third party.

Authorization: Any use of the Protected Materials outside the scope expressly permitted in this Agreement requires the prior written consent of xBrat Mobile Technologies FZCO. The Provider may grant, withhold, or condition such consent at its sole discretion.

5. Disclaimers

Accuracy of Signals: xBratAI provides trading signals for informational purposes only. xBrat Mobile Technologies FZCO does not guarantee the accuracy, reliability, or completeness of the signals. Signals may be delayed, incomplete, inaccurate, interrupted, or unavailable, and may rely on third-party market data that is itself delayed or erroneous.

Past Performance: Past performance is not indicative of future results. No representation is made that any signal, strategy, or methodology has been or will be profitable, and historical or hypothetical results should not be relied upon as a guarantee of future outcomes.

Risk Acknowledgment: Trading involves significant risks, including the potential loss of capital. You acknowledge that you are solely responsible for your trading decisions and outcomes, and for independently evaluating the suitability, appropriateness, and risk of any trade in light of your own financial circumstances, objectives, and applicable laws.

No Financial Advice: xBratAI does not provide financial, investment, tax, or legal advice. Consult a qualified professional before making trading decisions.

No Fiduciary or Advisory Relationship: Nothing in this Agreement or your use of xBratAI creates a fiduciary, advisory, agency, or similar relationship between you and xBrat Mobile Technologies FZCO. The Provider does not act as a broker-dealer, investment adviser, financial adviser, or portfolio manager, and does not manage accounts, execute trades, or hold customer funds.

Availability and Jurisdiction: xBratAI may not be available in all locations and is not offered where its use would be prohibited or restricted by applicable law, sanctions, export controls, or financial regulations. You are responsible for ensuring that your use of the App is lawful in your jurisdiction.

6. Limitation of Liability

No Liability for Losses: xBrat Mobile Technologies FZCO is not liable for any losses, damages, or expenses incurred as a result of your use of xBratAI or reliance on its trading signals.

Exclusion of Damages: To the maximum extent permitted by law, xBrat Mobile Technologies FZCO is not liable for indirect, incidental, consequential, or punitive damages, even if advised of the possibility of such damages.

Maximum Liability: xBrat Mobile Technologies FZCO's total liability under this Agreement is limited to the amount you paid for xBratAI, if any.

7. Termination

Termination by Provider: xBrat Mobile Technologies FZCO may terminate this Agreement and your access to xBratAI at any time if you violate its terms.

Termination by User: You may terminate this Agreement by ceasing all use of xBratAI and deleting it from your devices.

Effect of Termination: Upon termination, your license to use xBratAI will immediately cease, and you must delete all copies of the App in your possession.

8. Governing Law

This Agreement is governed by the laws of the United Arab Emirates, without regard to its conflict of law principles. Any disputes arising under this Agreement will be resolved exclusively in the courts of Dubai, UAE.

9. Amendments

xBrat Mobile Technologies FZCO reserves the right to modify this Agreement at any time. Changes will be communicated to you through xBratAI or other means. Continued use of xBratAI after such changes constitutes your acceptance of the revised Agreement.

Acknowledgment

By using xBratAI, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

REFUND POLICY

Please be advised that all sales are final. No returns, refunds, or exchanges, partial or otherwise, for any reason. Once your subscription order has been placed and your credit card billed or processed through PayPal or Payment Collection agent, there are no returns or credit. If you have a monthly subscription, it is your responsibility to cancel regular payments through PayPal or Credit Card.
